2. The petitioner seeks bail in connection with S.T. No. 174 of 2025 arising out of Kodhobari P.S. Case No. 38 of 2025 registered for the offence under Sections 103(1), 3(5) of the BNS.
3. As per the prosecution case, the petitioner is the wife of the deceased and it has been alleged that she, along with other criminals, had killed the deceased. During investigation, it has come that the petitioner was having an extramarital affair with another man staying in Mumbai and she used to visit Mumbai without informing her husband.
4. The petitioner is in custody since 30.04.2025.
5. It has been submitted by the learned counsel for

No.63197 of 2025(2) dt.17-09-2025 2/2 the petitioner that the deceased has committed suicide which is also apparent from the fact that there is no external injury found on the body of the deceased and if the petitioner would have hanged the deceased on a tree then there must be some mark of struggle on his body which is not found in the present case.
6. Learned counsel for the State has vehemently opposed the application of the petitioner for grant of bail.
7. From the FIR, it appears that the dead body of the deceased was found hanging from a tree and the petitioner was not found there.
8. Considering the aforesaid facts and also considering the fact that there is no direct evidence against the petitioner, this application is allowed.
9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-1st, Kishanganj/concerned Court below in connection with S.Tr. No. 174 of 2025 arising out of Kodhobari P.S. Case No. 38 of 2025. (Sandeep Kumar, J) Vikas/- U
