2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 149, 341 , 323 , 325 , 308 , 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with other co-accused persons are alleged to have assaulted the father of the informant by means of iron rod and also assaulted informant and his family members.
4. It is submitted on behalf of the petitioner that allegation of assault is general and omnibus. The present case is counter blast of Atri P . S. Case No. 29 of 2021 which was lodged by petitioner's side against the informant and his associated. In the present case , there is no witness who has
Patna High Court CR. MISC. No.70018 of 2023(3) dt.27-02-2024 2/2 supported the allegation against the petitioner. Injuries sustained by the injured is found to be simple in nature .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the nature of injury and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XIII , Gaya in connection with Atri P.S. case No. 30 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
