It is rightly pointed out by learned counsel for the State that this is second writ petition seeking the same relief for quashing of the letter no. 182 dated 22.3.2011, whereby petitioner's claim for compassionate appointment was rejected. In the earlier round of litigation arising out of C.W.J.C.No. 14223 of 2011, this Court had observed that claim of the petitioner was not genuine inasmuch as there was no authentic document in support of his date of birth. Such observation was made in order dated 9.2.2012 of the earlier proceeding. It is thereafter on 27.2.2012 the petitioner has withdrawn the earlier writ petition for pursuing departmental

It will be worth noticing that having withdrawn the earlier writ petition, the instant writ petition has been filed that also without obtaining liberty in the earlier proceedings. In view of the aforesaid circumstances, this Court does not find any merit in the writ petition. The same is dismissed. (Madhuresh Prasad, J) Shashi.
