In course of argument considering the fact that the distance between the Jehanabad to Patna is not much more, learned counsel for the opposite party submits that in fact whole effort of the opposite party is towards the restitution of the conjugal rights and for that purpose he would not object to the transfer of the case from the court at Jehanabad to the court at Patna. It is, however, submitted that the Family Court at Patna should take up this matter with an intention to mediate between the parties at the first instance.

Learned counsel representing the petitioner has not objected to take this matter through the mediation for the purpose

Patna High Court MJC No.1578 of 2018 (5) dt.13-09-2018 of settlement between the parties.

In the given circumstance, let the records of Matrimonial Case No. 19 of 2017 pending in the court of learned Principal Judge, Family Court, Jehanabad be transferred to the court of learned Principal Judge, Family Court, Patna within a period of 15 days from the date of receipt/production of a copy of this order. After receipt of the records, the learned Principal Judge, Family Court, Patna shall take appropriate steps towards mediation between the parties.

Learned counsel for the opposite party submits that to meet the expenses of the petitioner in attending the court at Patna he will also pay Rs. 200/- towards the traveling cost and also cooperate so that the matter may be expedited. Learned counsel representing the petitioner submits that the petitioner will definitely cooperate during the mediation and shall ensure earliest disposal of this case. The applications stands disposed off.
