The petitioner apprehends his arrest for the offences punishable under sections 420, 409, 467, 468 and 471/34 of the Indian Penal Code.

The petitioner is ward member of ward no. 9 of Bandhauli Gram Panchayat, Block- Jalley, District- Darbhanga. He along with assistant of Indira Aawas Scheme alleged to have taken commission from the beneficiaries of Indira Aawas Scheme. It is submitted that the allegation is false and concocted. The petitioner himself filed a petition which is at page 51 of the bail petition, on the basis of which enquiry was held. Indira Aawas beneficiaries got their money deposited through

Patna High Court Cr.Misc. No.51961 of 2015 (2) dt.22-12-2015 2/2 cheques to their account and the petitioner did not receive any commission from any of the beneficiaries. There is no documentary evidence to show that the petitioner took commission from any of the Indira Aawas beneficiaries. Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Darbhanga in Jalley P.S. Case No. 130 of 2015, subject to the conditions as laid down in section 438

(2) of the Code of Criminal Procedure, 1973.
