The petitioner is facing accusation under sections 307 and 379 IPC lodged by her agnate. She prays for grant of anticipatory bail.
Learned counsel for the petitioner submits that from the FIR itself it shall appear that both parties are agnates and had land disputes. Owing to such disputes, it is alleged that the entire family entered into the house and assaulted the informant, his father and mother. It is further submitted that all these allegations are attributed to the male accused(s). There is general allegation that the wife of the main accused also participated in the crime. In particular, the allegation against the petitioner is of having snatched the silver chain. It is submitted
Patna High Court Cr.Misc. No.46799 of 2017(2) dt.21-09-2017 2/2 that such allegation is ornamental with a view to rope in more accused persons. The petitioner being a lady, has no criminal antecedents.
In the circumstances, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each, to the satisfaction of Chief Judicial Magistrate, Madhepura in Murliganj P.S.
