JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This application, for grant of anticipatory bail, arises out of Baikunthpur P.S. Case No. 99 of 2019, disclosing offences under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.
Prosecution case is that a dispute arose between the parties on cutting of the tree, in which, the petitioner and others started abusing the informant and specific allegation against this petitioner is that he assaulted one Satyendra Singh by means of farsa and other accused persons assaulted Prashant Kumar Singh and others.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and persons from the petitioner's side have also sustained injuries
Patna High Court CR. MISC. No.58649 of 2019(2) dt.17-09-2019 2/2 and the the injury sustained by the Satyendra Singh was found simple in nature cause by hard and blunt substance. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 99 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
