2. The petitioners apprehend their arrest in a case in connection with Khagaria (Chitraguptnagar) P.S. Case No. 444 of 2022, registered for the offences punishable under Sections 406, 420, 385 and 120 (b) of the Indian Penal Code.
3. As per F.I.R., allegation against the petitioner no.1 is that by showing forged documents he purchased the land of the informant and allegation against petitioner no. 2 is that he abuses the informant.
4. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present
Patna High Court CR. MISC. No.67464 of 2023(3) dt.23-01-2024 2/2 case. Petitioner no. 2 has got no criminal antecedent whereas petitioner no. 1 has 11 criminal antecedents of similar nature mentioned in Para 3 of the bail application. On bare perusal of the F.I.R., Title Suit is also going on between the parties.
5. Learned APP for the State has opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case and also it is a civil dispute between the parties, let the above named petitioners, be released on bail, in the event of their arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Khagaria (Chitraguptnagar) P.S. Case No. 444 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
