Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner seeks regular bail in connection with Daudpur P.S. Case No.274 of 2022 registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
As per the prosecution, the police personnel on patrolling duty apprehended this petitioner with co-accused person and seized a vehicle bearing Registration No. - UP 14 CC 9619 and recovered two number plates bearing Registration
Patna High Court CR. MISC. No.63336 of 2022(2) dt.23-02-2023 2/3 No. - AP 39AZ 1999 and further it is alleged that the accused persons were involved in selling of banned liquor. The main submissions advanced by the learned counsel Mr.
Chandra Mohan Jha for the petitioner are that the petitioner is stated to have been arrested from the alleged vehicle but in actual he was not present in that vehicle and on suspicion he was arrested and from the alleged vehicle two number plates of the vehicle were recovered and the same were presumed to be forged and the petitioner was alleged to be indulged in the smuggling of wine but no recovery of the wine was made from the possession of this petitioner from the alleged vehicle and one co-accused Nagendra Kumar who was also apprehended at the spot with this petitioner has been granted bail by the trial Court itself and the petitioner's signature or his LTI was not taken on the seizure memo of the alleged vehicle and number plates.
Further submission is that against the petitioner there is criminal antecedent of one case in which he has been acquitted and he has been languishing in jail since 15.09.2022.
Learned APP Mr. Shailendra Kumar Singh appearing for the State has opposed the bail prayer.
In view of the facts, as stated above, and mainly
Patna High Court CR. MISC. No.63336 of 2022(2) dt.23-02-2023 3/3 considering the petitioner's custody period and stage of his trial, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Daudpur P.S. Case No.274 of 2022.
