JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-11-2016 Heard the counsel for the petitioners and learned APP for the State.

The three petitioners herein are lodged in custody since 14.04.2016, 17.03.2016 and 06.02.2016 respectively in connection with I. F. Case No. 15 of 2016 (T. R. No. 1200/16) registered under diverse penal provisions of the Indian Forest Act and Wild Life (Protection) Act, 1972. As per the prosecution case, the Forest Range Officer on getting information that an Indian Gaur (protected animal) was hunted and his meat was distributed among the villagers, recorded the case and went

A search was carried out in which dry meat, Chauka, Bhala, Net, Tangi etc. were found and seized under a memo. As per the complaint, the petitioners and others are alleged to have committed the offence under the provisions of the Indian Forest Act and the Wild Life (Protection) Act. It is submitted that considering the allegation and other materials available on record several co-accuseds of this case have been granted bail vide orders dated 20.8. 2016 and 04.10.2016 (Annexure-2 series) and the case of the petitioners are on identical/similar footing. They do not carry any criminal antecedents.

Considering the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of ACJM, Bagaha, West Champaran in Tr. No. 1200 of 2016 (arising out of I. F. Case No. 15 of 2016) on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, they shall appear in person on each date fixed at the trial. In case they fail to
