JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-379, 354-B & other minor sections of the Indian Penal Code.
It is stated that the petitioner gave single farsa blow, causing injury to the informant's wife. The doctor found three injuries on the person of injured, said to be caused by hard and blunt substance and all the injuries were found simple in nature. Submission on behalf of petitioner is that there was dispute regarding drainage but the aforesaid fact was suppressed by the informant. Moreover, the petitioner is in jail custody since 12-08-2016.
It is surprising enough that the learned Sessions Judge,
Patna High Court Cr.Misc. No.46488 of 2016 (2) dt.24-10-2016 2/2 Araria did not consider the aforesaid fact nor applied his judicial mind while considering the bail prayer of the petitioner. However, taking note of the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kursakanta (Kuwari O.P.) P.S. Case No. 129 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Araria.
