JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Heard learned counsels for the petitioners and the State. The petitioner no.1 being the husband of the daughter of the informant and petitioner nos. 2 to 4 being the brother of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Sections 498A, 380 and 364 of the Indian Penal Code.

The basic accusation is of inflicting torture and kidnapping the daughter of the informant.

It is submitted by learned counsel for the petitioners that the daughter of the informant eloped with someone else, hence, the informant has retracted from his initial version and filed a petition to that effect before the learned court below, the same has been brought on record as Annexure-2 to the petition. Moreover,

Patna High Court Cr.Misc. No.50214 of 2015 (2) dt.30-10-2015 2/2 as per the own admission of the informant, he came to know about disappearance of the victim on 22.08.2012 when the complaint was filed on 31.01.2013 which came to be registered as a police case on 14.03.2015.

Considering the delayed lodging of the case and retracted version of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Saharsa in connection with Basnahi P.S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
