2. The petitioner has preferred this application for grant of regular bail in connection with Special Case (NDPS) No. 19/2024 arising out of Beldaur P.S. Case No. 277/2024 dated 30.07.2024 registered for the offence punishable u/s 8, 20(b)(ii)(B), 22(b) of the NDPS Act and Sections 25(1B)a, 25(1-AA), 26 and 35 of the Arms Act.

3. As per the prosecution case, total 20 country-made pistols, 79 live cartridges, 3.400 grams ganja and a mobile phone were recovered from the shop.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious

Patna High Court CR. MISC. No.66982 of 2024(3) dt.29-11-2024 2/2 possession of the petitioner. The petitioner is not the owner of the said shop. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 30.07.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that 20 country-made pistols, 79 live cartridges, 3.400 grams ganja and a mobile phone were recovered from the shop of the co-accused Pappu Patel, who is father of the petitioner. It is further submitted that the co-accused, Pappu Patel has stated that the petitioner and the co-accused persons are involved in the alleged business of illegal weapons and ganja. It is further submitted that the petitioner also runs the said shop.

Considering the aforesaid facts and circumstances of the case as well as material available on record, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Special Case (NDPS) No. 19/2024 arising out of Beldaur P.S. Case No. 277/2024 pending in the court of learned Special Judge (NDPS Act), Khagaria.

7. This application stands rejected.
