The petitioner seeks bail in connection with Ara Nagar P.S. Case No. 475 of 2022 registered for the offences punishable under Sections 21(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and is in custody since 31.05.2022 and allegation is of recovery of two mobiles and Rs. 1500/- from the petitioner, it is next alleged that heroine like substance weighing 440 gm was recovered from one Binod. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case and from bare perusal of the allegation as alleged in

Patna High Court CR. MISC. No.68056 of 2022(2) dt.29-04-2023 2/2 the F.I.R., it would manifest that no narcotic was recovered from his possession.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ara Nagar P.S. Case No. 475 of 2022.

Accordingly, the present bail application stands allowed.
