1. Heard learned Counsel for the parties concerned.

2. The petitioner has filed the present writ application for a direction to the respondents to grant Matric Trained Pay Scale to the petitioner upon completion of three years of his initial appointment on the post of Assistant Teacher.

3. Learned Counsel for the petitioner submits that the case of the petitioner is fully covered by the order passed by a Co-ordinate Bench of this Court, in the case of Abdus Samad v. The State of Bihar and Others (C.W.J.C. No. 7322 of 2017), dated 11.04.2018.

4. On the other hand, learned Counsel for the State submits

Patna High Court CWJC No.14098 of 2024(2) dt.17-09-2024 2/2 that the present writ application may be disposed of in terms of Abdus Samad (supra).

5. Having heard learned counsel for the parties and considering the aforesaid submissions, the application is disposed with liberty to the petitioner to approach the District Progamme Officer (Establishment), Sheohar, (respondent no. 5) by filing a representation within a period of three weeks from today, which shall be decided by the respondent no. 5 within a period of two months from the date of receipt of the representation.

6. If it is found that the case of the petitioner is covered by the case of Abdus Samad (supra), then similar benefit shall be granted to the petitioner.
