JUSTICE ARVIND SRIVASTAVA ORAL ORDER 05-12-2017 In view of the order dated 23.11.2017, the application of petitioner no. 2 is dismissed as withdrawn. Heard learned counsel for the petitioner no. 1 and the learned A.P.P. for the State.

The petitioner no. 1 apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 380 of 2016 registered under Sections 498A, 302, 201/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that this is a complaint case filed under section 302 of the I.P.C. Petitioner no. 1, who happens to be the husband of the deceased, is innocent and has committed no offence as alleged.

Having considered the facts and circumstances of the case, let the above named petitioner no. 1 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 380 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
