2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in Lakhisarai P.S. Case No. 460 of 2024 registered for the offence punishable under Sections-319(2), 318(4), 338, 336(3), 340(2), 61(2) of the Bhartiya Nyay Sanhita, 2023 and Section-10 of Bihar Examination Act, 1981.

4. It is a case of impersonation, in which, the coaccused, Arun Choudhary on the basis of forged ID, impersonated himself to be a Biometric employee at Lakhisarai centre in an examination which was being conducted by BPSC.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has been made accused in this case on the basis of mere suspicion based on hypothesis only. No any incriminating articles or objectionable documents or electric materials of any kind was recovered from possession of the petitioner nor any fake or forged documents were found during search of the petitioner at the relevant time of occurrence. The co-accused namely Arun Choudhary has been granted bail by this court by order dated 07-10-2024 passed in Cr. Misc. No. 68964 of 2024. The case of the petitioner is on better footing to that of co-accused who has been granted bail. The petitioner is a person of clean antecedent and is in custody since 21-07-2024.

6. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 460 of 2024 with condition that the petitioner shall

8. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any case other than the present one, his bail bonds shall not be accepted.
