The petitioner seeks bail in connection with Rajapakar P.S. Case No.43 of 2019, which was initially registered for the offences under Sections 356 and 379 read with 34 of the Indian Penal Code, but subsequently, on completion of investigation charge-sheet has been submitted under Section 397 of the Indian Penal Code.
Considering that complicity of the petitioner was found in a case of robbery on the point of pistol and he is involved in at least two other similar cases, I am not inclined to grant him bail for the present even though he is in custody since 01.06.2019. The prayer for bail is rejected.
The learned Chief Judicial Magistrate, Vaishali at Hajipur is directed to commit the case of the petitioner to the
Patna High Court CR. MISC. No.63144 of 2019(3) dt.04-12-2019 2/2 Court of Sessions for trial forthwith. The learned Sessions Judge, Vaishali is directed to ensure speedy trial of the case. In case, the trial is not completed within nine months from the date of framing of charge, the petitioner would be at liberty to renew his prayer for bail before the Court of Sessions itself.
