2. In the present case, the petitioner seeks bail in connection with Special Excise Case No. 1542 of 2025, arising out of Danapur P.S. Case No. 604 of 2025 registered for the alleged offences under Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

3. As per prosecution case, recovery of 42 liters of illicit foreign liquor was made from an Alto car being driven by the petitioner. Further, recovery of 450 litres of illicit foreign liquor was made from the house of co-accused Amit Kumar @ Pintu at the instance of this petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. The petitioner is the driver of the vehicle seized by the police but the petitioner has no knowledge about the liquor kept in the vehicle. The car belongs to coaccused from whose house further recovery of foreign liquor was made. Therefore, nothing incriminating has been recovered from the conscious possession of the petitioner, who is having clean antecedent. The petitioner is in custody since 11.06.2025 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the submission of charge sheet and further considering the period of custody of the petitioner and his clean antecedent, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur/concerned Court in connection with Special Case No. 1542 of 2025, arising out of Danapur P.S. Case No. 604 of 2025, subject to the conditions mentioned in Section

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
