JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Sikandra P.S. Case No. 24/2017 registered under Section 186, 188, 408, and 409 of the Indian Penal Code.

As per the prosecution case, petitioner happens to be Panchayat Secretary of Gram Panchayat Raj Bichhabey and Mircha Pathakchak under Sikendra Block. He has not made over the charge of the post of Panchayat Secretary of the Panchayat to his successor despite giving him letter and show cause. It is submitted by learned counsel for the petitioner that the petitioner has already made over the charge of Gram Panchayat Raj Bicchhabey on 16.01.2017. So far as Gram Panchayat Raj Mircha Pathakchak is concerned, the petitioner is

No.46080 of 2017 (02) dt.20-09-2017 2/ 2 ready to hand over the charge to his successor Sunil Kumr Singh and has requested him invariably for the same but he is not taking the charge for which the petitioner has written letter to the District Panchayat Raj Officer, Jamui on 12.07.2016. Thus, the petitioner has made no offence. The petitioner has been languishing in custody since 22.07.2017 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No.24/2017 (G.R. No.243/2017).
