JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-09-2019 The present writ petition has been filed for directing the respondents to remove the encroachment made by the private respondents over the Government Land (Aam Gairmajarua land)/public road situated under Mauza-Belahiya, Thana No. 140, Khata No. 286, Plot No. 1491, Circle-Adapur, District-East Champaran.

In case the petitioner is seeking removal of encroachment made over the public land, he is required to approach the Circle Officer, Adapur District-East Champaran under the provisions of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956') for redressal of his grievances.

Patna High Court CWJC No.18199 of 2019(2) dt.12-09-2019 2/2 Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to the petitioner to approach the Circle Officer, Adapur, DistrictEast Champaran by filing appropriate complaint under the provisions of the Act, 1956 and in case such an application/complaint is filed, the Circle Officer, Adapur, District-East Champaran shall take appropriate action in accordance with the provisions of the Act, 1956. The writ petition stands disposed off on the aforesaid terms.
