JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Mahila P.S. Case No. 71 of 2021 registered for offence punishable under sections 376, 498A, 323/34 of the Indian Penal Code and 67 (A) I.T. Act.

As per allegation, the marriage of the informant was solemnized with co-accused Rajesh Kumar. The couple had no issue. Her matrimonial inmates made pressure upon her to establish physical relation with the petitioner and co-accused Ravikant Kumar, who are brothers-in-law (Devar) of the informant. They tortured her as she was not ready to make physical relation with them. Having no option, she made physical relation with the petitioner and co-accused Ravikant Kumar. Her

It has been alleged that her husband, brother-in-law and parents-in-law also demanded Rs.5,00,000/- cash as dowry. The learned counsel for the petitioner has submitted that entire allegation is false. She has made accused of matrimonial inmates of the petitioner. He has also submitted that the husband of the alleged victim against whom there was an allegation of making video has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 26038 of 2022. The petitioner is under custody since 12.08.2022.

Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Mahila P.S. Case No. 71 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
