JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Lalganj P.S. Case No. 414 of 2018 registered for the offences punishable under Sections 341, 342, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
Almost all the sections are bailable in nature except Section 27 of the Arms Act but admittedly, nothing was recovered from conscious possession of the petitioners nor the seized cartridges were recovered by the investigating officer rather the seized cartridges were produced by the informant
Patna High Court CR. MISC. No.59115 of 2019(3) dt.20-11-2019 2/2 before the police. Furthermore, there appears to be enmity between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur in Lalganj P.S. Case No. 414 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) shahzad/- U T
