JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 8 07-01-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of respondent no. 4.

The prayer of the petitioner in the present writ petition is to quash the FIR as well as the entire criminal proceeding arising out of Katihar Town P.S. Case No. 154 of 2010 registered for the offences punishable under Sections 420, 465, 468, 471 and 120B of the Indian Penal Code.

WJC No.920 of 2013 (8) dt.07-01-2015 2 / 2 At the outset, learned counsel for the petitioner concedes that police have already completed investigation in the case and submitted their report under Section 173(2) of the Code of Criminal Procedure before the Court of Magistrate and the concerned Magistrate has already been taken cognizance of the matter.

In that view of the matter, the learned counsel for the petitioner seeks leave to withdraw the present writ petition in order to challenge the order taking cognizance by filing an appropriate application.

Leave is granted.

The application is disposed of as withdrawn with liberty aforesaid.
