ANJANA MISHRA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the entire allegations are misconceived and are based on the statement of driver of the vehicle with which the commodity was seized. He further submits that the only allegation against the petitioner is that, it has been lifted from the shop of the present petitioner. However, there is no cogent material to support the said allegation.

Considering the nature of allegation made and that the

No.49321 of 2016 (2) dt.25-11-2016 P2/2 petitioner has a clean antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhepura in connection with Gamhariya P.S. Case No. 119 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
