JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2024 At the outset, learned counsel for the petitioners seeks permission to withdraw the pre-arrest bail petition with respect to petitioner No. 2.
2. Permission is accorded.
3 . This bail petition of petitioner No. 2 is dismissed as withdrawn .
4. Heard learned counsel for the petitioner No. 1 and the State .
5 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 324, 341 , 379, 354(A), 504, 506, 307 and 34 of the Indian Penal Code .

6. As per prosecution case , on the alleged date and time of occurrence , when wife of informant and sons of informant were on road , in the meantime , all the F.I.R., named accused persons abused and assaulted them and accused persons threatened family members of informant with dire consequences. It is further alleged that this petitioner and others snatched gold chain from informant sides.
7. Learned counsel for the petitioner submits that specific accusation of assault is against other co-accused persons and so far as this petitioner is concerned, there is no allegation of any overt act is alleged against him. Rest of the allegations are ornamental in nature . Petitioner claims clean antecedent.
8 . Learned counsel for the State opposes the bail petition of the petitioner.
9. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner No. 1 as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like
