JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-02-2016 By filing supplementary affidavit on behalf of the petitioners, learned counsel for the petitioners submits that, in fact, the present application has been filed on behalf of Vidyanand Singh and the Praveen Singh, both sons of Lal Babu Singh, who have been shown as accused Nos. 5 and 6 in the First Information Report, but inadvertently, the name of the petitioner no.2 has wrongly been typed as Praveen Singh @ Chhakauri Singh, who is also an accused shown at serial No. 3 of the F.I.R, in place of Praveen Singh. In view of the above, learned counsel for the petitioners is permitted to correct the same.

Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Begusarai

Patna High Court Cr.Misc. No.50657 of 2015 (2) dt.05-02-2016 2/2 Muffasil (Singhaul) P.S. Case No. 310 of 2015, registered under Section 147, 148, 149, 307 & 326 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioners submits that petitioners are named in the F.I.R. along with 8 others, but there is specific allegation only against Samrat Singh, who on the instigation of Praveen Singh @ Chhakauri and Tantan Singh, caused injury to Nitin Kumar, cousin or the informant, Kamal Singh. Moreover, the petitioners were simply the members of the mob. Further submission is that petitioners are accused in three other cases, as detailed in para-3 of the application, but in all the cases, petitioners are on bail. Similarly situated co-accused, Pankaj Singh has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 02.02.2016 passed in Criminal Misc. No. 3156 of 2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil (Singhaul) P.S.
