2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 329(3), 232, 352, 351(2)(3) and 2(5) of B.N.S.

3. As per the F.I.R., it is alleged that all the named accused persons, including this petitioner, threatened the informant with dire consequences, stating that she would be killed if she deposes in Khagaria Muffasil P.S. Case No. 322 of 2019.

4. Learned counsel for the petitioner submits that as a matter of fact, the informant and her three sons had already been examined and cross-examined prior to the institution of the

Patna High Court CR. MISC. No.62914 of 2025(2) dt.10-09-2025 2/2 present F.I.R., and therefore the very foundation of allegation is belied. The very motive which is alleged for the occurrence do not exist at the time of institution of F.I.R. Only out of enmity this false and concocted case has been lodged with vague and ambiguous allegations.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and the fact that F.I.R., has been lodged after the examination and cross-examination of the informant and her sons, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Muffasil P.S. Case No. 83 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
