1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 366 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his wife fled away with Rs.25,000/- and ornaments. On inquiry, it transpired that his wife used to talk to Kunal Paswan and petitioner and the informant also disclosed their mobile number. It is further alleged that the accused enticed her away for marriage.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that petitioner is a person with clean antecedent and from perusal of the allegation as alleged in the

Patna High Court CR. MISC. No.64020 of 2025(2) dt.24-09-2025 2/2 FIR, it would manifest that the wife of the informant had fled away from the house with Rs.25,000/- in cash and ornaments which amply demonstrates that she was not enticed rather on her own volition she left her husband's house. It is next submitted that no doubt, the victim came back and her statement was recorded under Section 183 BNSS wherein she supported the case of the prosecution and stated that accused persons abducted her but then it is submitted that had the accused abducted the victim in that event the victim would not have fled away with cash and ornaments.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Nawkothi P.S. Case No. 90 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
