The application is for grant of bail in connection with Fatua PS case no. 373/2014 for the offence under Sections 399, 402, 414, 420, 467, 471, 371 of the Indian Penal Code and 25(1-B)A, 26, 35 of Arms Act.

It is submitted on behalf of petitioner that there is nothing against the petitioner except confessional statement of coaccused and he is implicated in this case on the basis of CCTV footage. It is further submitted that though there are several cases against the petitioner but in all the cases, he is on bail and petitioner has not been put on T.I.P. It is further submitted that petitioner is in custody for more than seven months.

Patna High Court Cr.Misc. No.49034 of 2016 (3) dt.16-01-2017 2/2 opposed the prayer for bail and submits that petitioner is an accused in large no. of cases and CCTV footage shows his implication in the present case.

Having heard both sides. It appears from para 3 of bail petition that there are large number of cases pending against the petitioner but in the present case, except CCTV footage and confessional statement of co-accused, there is nothing against the petitioner. As such, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Gayanti Kumar, Judicial Magistrate 1st class, Patna in connection with Parsa Bazar P.S. case no. 115 of 2016 with condition that both the bailors should be the respectable persons of society having property within the jurisdiction of the court below and repetition of the offence may cause cancellation of bail bonds of petitioner in this case. Police will be watchful and if any occurrence is repeated, the police may move before the court below for cancellation of his bail bonds.

With these observations, this bail application is allowed.
