====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Raghunathpur P. S. Case No. 28/2022 in a case registered for the offences under Sections 304(B)/34 of the Indian Penal Code.

3. It is a case of dowry death. As per the prosecution case, this petitioner along with other accused persons killed the daughter of informant by pressing her neck, due to nonfulfillment of demand of Rs. 80,000/- and four wheeler as dowry.

4. Learned counsel for the petitioner submits that petitioner is father-in-law of the deceased and he is separate in

Patna High Court CR. MISC. No.68849 of 2024(2) dt.19-12-2024 2/2 mess and property. Petitioner has got no concern with family affairs of the deceased and he is simply victim of over implication. Informant is not an eye witness of the occurrence. Petitioner is in custody since 15.05.2024 and chargesheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P. S. Case No. 28 of 2022.
