2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30 (a) of the Bihar Prohibition and Excise Act,

3. The case of the prosecution is that altogether 20 liters of country made foreign liquor was recovered from a bike.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. Further submission is that petitioner has been made accused in this case as he is the owner of the bike but nothing has been recovered from the conscious possession of the petitioner. However, the petitioner has been languishing in judicial custody since 27.07.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has two criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shikarpur P.S. Case No. 771 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No. II, Bettiah, West Champaran with condition that the petitioner shall not indulge in similar nature of offence in future.
