17-10-2017 Heard Sri Abhay Kumar Thakur, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in connection with Salimpur P.S. Case No. 80 of 2017 registered for offence under Sections 30(A), 37(A) of Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender.

It was submitted by learned counsel for the petitioners that petitioners' name has come on the basis of confessional statement of co-accused. He submits that it was alleged that on verandah, three persons were drinking and police conducted raid and from verandah, one accused was arrested, who was

No.48306 of 2017(2) dt.17-10-2017 2/2 agnates of the petitioners and from the place of occurrence, only half bottle of Indian make foreign liquor was recovered and coaccused disclosed the name of both the petitioners. He submits that the place, from where recovery was effected, was not in exclusive possession of both the petitioners and both the petitioners are having clean antecedent, which fact has been stated in paragraph - 3 of the petition.

Considering the facts and circumstances as well as clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let both petitioners namely Ajeet Kumar Singh @ Ajit Singh and Chandu Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Patna in connection with Salimpur P.S. Case No. 80 of 2017, corresponding to Special Case No. 2410 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
