The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 179 of 2017, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of three container each containing 20-25 litres country made liquor from the bush near the bank of river at village Kango Bigha. On seeing the police personnel, 3-4 persons, who were present near the bank of river, succeeded to flee away towards forest. On query, informant came to know that petitioner along with Chouty Rajbanshi and and Sarju Yadav used to do the business of illicit liquor.

Patna High Court CR. MISC. No.60421 of 2019(2) dt.24-09-2019 2/2 Learned counsel for the petitioner submits that petitioner was not apprehended at the spot but mere on suspicion, his name has surfaced in the present case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cumSpecial Judge, Nawada, in connection with Rajauli P.S. Case No. 179 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
