2. The petitioner apprehends arrest in connection with Jandha P.S. Case No. 225 of 2025 lodged on 31.05.2025, for the offences punishable under sections 8(c), 22(b), 25 and 29 of the the Narcotic Drugs and Psychotropic Substances, Act, 1985.
3. The allegation is of the recovery of 6.10 grams of heroin from the pocket of the co-accused Saurav Kumar @ Gaurav.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioner and his name has been dragged into the present case merely on
Patna High Court CR. MISC. No.63144 of 2025(2) dt.10-09-2025 2/3 the basis of the confessional statement of co-accused Saurav Kumar @ Gaurav, from whose possession the alleged recovery was made. Further submission is that similarly situated persons, namely Nishant Kumar has been granted anticipatory bail by this Court vide order dated 27.08.2025 passed in Cr. Misc. No. 55990 of 2025 by a Co-ordinate Bench of this Court. It is also submitted that the apprehended accused, namely Saurav Kumar @ Gaurav, has also been granted regular bail by a Co-ordinate Bench of this Court vide order dated 18.08.2025 passed in Cr. Misc. No. 52954 of 2025. Lastly, it is submitted that the petitioner has a clean antecedent.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal District and Sessions Judge, Vaishali, Hajipur, in Jandaha P.S. Case No. 225 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
