2. This application, for grant of anticipatory bail arises out of Bachhwara P.S. Case No. 27 of 2024, disclosing offences under Section 366(A) of the I.P.C.
3. The prosecution case, as per the F.I.R. is that from 27.01.2024, the daughter of the informant aged about 16 years was missing and upon search, the informant got the knowledge that the petitioner has kidnapped her minor daughter.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case with oblique motive. He further submits that the victim girl was matured and she has disclosed her age as 17 years at the time of recording her statement under Section 164 of the Cr.P.C., however, she refused to undergo the medical examination. Patna High Court CR. MISC. No.66926 of 2024(2) dt.03-10-2024 2/2 further submits that the statement of the victim was recorded under Section 164 of the Cr.P.C. in which she has stated that she was scolded by her mother and thereafter, she went to Delhi along with the petitioner on 22.01.2024. The victim girl and the petitioner performed marriage in a temple on 27/28.01.2024.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the statement of the victim girl recorded under Section 164 of the Cr.P.C., I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, in connection with Bachhwara P.S. Case No. 27 of 2024, subject to the condition laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Sinha, J) sadique/- U T
