Petitioners apprehend their arrest in a case under section 307 and other allied sections of the Indian Penal Code on the allegation that they entered into the house of the informant and assaulted by fists and leg, and thereafter by log, causing head injury to his wife as well as fracture injury on her right arm.

The petitioners submit that the injuries are not grievous. Furthermore, there was no repetition of blows. Counsel for the State opposes the prayer submitting that the grounds raised by the petitioners can be considered for regular bail.

In the facts of the case, petitioners as mentioned above

Patna High Court Cr.Misc. No.51543 of 2015 (3) dt.25-01-2016 2/2 are directed to surrender and seek regular bail, which would be disposed of on its own merit preferably on the same day without prejudice.
