The petitioner is apprehending his arrest in connection with G.O.Case No.495 of 2019 arising out of Bahera P.S.Cas No.232 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is about recovery of altogether 1080 bottles of 300 ml. each of nepali sufi liquor from the Dalan of the petitioner .

Submission of the learned counsel for the petitioner is that the house is a joint family house and he has falsely been implicated in this case, having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is dispsodof

Patna High Court CR. MISC. No.61003 of 2019(2) dt.25-09-2019 2/2 with direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to he disposed of on the same day.

With the aforesaid direction, this application is disposed of.
