JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 23-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 30 (b) (c) of the Bihar Prohibition and Excise Amendment Act, 2018. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious physical possession of the petitioners rather 2400 liters of country made liquor and several articles and apparatus for manufacturing of liquor is said to have been recovered from a forest. The allegation against the petitioners is that they are involved in making of illicit liquor. They have no concern either

Patna High Court CR. MISC. No.69072 of 2022(2) dt.23-12-2022 2/2 with the seized liquor or the place of recovery or any trade of liquor. They have been falsely implicated in this case at the instance of their enemy. Petitioners have no criminal antecedent as mentioned in para-3 of this application.

Considering the recovery of huge amount of liquor as well as several articles and apparatus for manufacturing of illicit liquor, I am not inclined to enlarge the petitioners on anticipatory bail. Their prayer for anticipatory bail is hereby rejected and this application is dismissed.
