JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 342, 323, 384 and 504/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that from the perusal of the case diary, it appears that the only allegation against the petitioner is that he, in connivance with one Asha Devi, cheated the informant and took Rs. 2,00,00/- from him on assurance of good returns. It has further been submitted that petitioner has no concern with the alleged amount and he has been falsely implicated in the present case.

Patna High Court Cr.Misc. No.49654 of 2016 (2) dt.19-12-2016 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the petitioner is not directly involved in the present case and the only allegation against the petitioner is that he helped the co-accused, Asha Devi, in the said offence, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, District - Madhubani, in connection with Lakhnour (R.S.O.P) P.S. Case No. 110 of 2016 (G.R. No. 1057 of 2016) subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
