2. The petitioner has preferred this application for grant of regular bail in connection with Ramgharwa P.S. Case No. 252 of 2024 dated 13.10.2024 registered for the offences punishable u/ss 96 and 70(2) of the B.N.S. and Sections 4 and 8 of the POCSO Act.

3. As per the prosecution case, the petitioner and the co-accused persons along with one unknown person are alleged to have committed rape on the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. The victim in her statement recorded u/s 183 of the

Patna High Court CR. MISC. No.64745 of 2025(2) dt.13-10-2025 2/2 B.N.S.S. has not taken the name of the petitioner in the alleged crime rather he has made specific allegation against the co-accused, Bullet Kumar and one unknown person who committed rape on her. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.06.2025.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Ramgharwa P.S. Case No. 252 of 2024.

7. The application stands allowed.
