Petitioner is languishing in custody since 15.09.2016 in connection with Hathua P.S. Case No. 58 of 2016 for offences punishable under Section 47(A) of the Bihar Excise (Amendment) Act, 2016.

From the house of this petitioner foreign liquor was recovered on 27.03.2016.

Submission of the petitioner is that the petitioner is in custody for more than two months and has got no criminal antecedent. Moreover, the house is occupied by other members of the family.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.50696 of 2016 (2) dt.23-11-2016 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Gopalganj, in connection with Hathua P.S. Case No.58 of 2016.
