This is a petition for grant of anticipatory bail for offence under Section 47(a) of the Bihar Excise (Amendment) Act, 2016.
From the road side country made liquor was recovered. The arrested person disclosed the name of this petitioner as co-accused.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Turkauliya (Raghunathpur O.P.) P.S. Case No. 351 of 2016 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code with the condition that the petitioner shall file undertaking before the Court below that he would not indulge in such activity in future and if
Patna High Court Cr.Misc. No.52674 of 2016 (2) dt.14-12-2016 the Court below will receive any report of violation of provision of the Bihar Excise (Amendment) Act, 2016, by the petitioner, the Court below shall be at liberty to cancel the bail bond of the petitioner in this case also.
