The petitioner Mukesh Yadav has been arrested in connection with Banmankhi P.S. Case No.178 of 2017 for the offences under Sections- 341/323/324/307/379/504/325/447/34 of I.P.C. Petitioner is in custody since 29.7.2017. Even though the applicant is said to be present on the spot along with other co-accused persons Gunjan Sah and Ujjwal Singh, no specific overt act is attributed to the petitioner. On the contrary, Ujjwal Singh who had assaulted the informant with an Iron rod, has been granted bail by this Court on 20th of September, 2017 in Cr. Misc. No.44801 of 2017. Considering the fact that the applicant is not alleged to have caused any injury but to have been present on

Petitioner above named is directed to be released on bail on furnishing the bail-bond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Purnea in connection with Banmankhi P.S. Case No.178 of 2017 arising out of CIS No.595 of 2017.
