Petitioner seeks bail in connection with Mali P.S. Case No. 59/17 for offences punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that during course of checking they intercepted a Tata Indica Car and apprehended two persons including the petitioner. From the car 92 litres of illicit liquor was recovered and, accordingly, a seizure-list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, nothing has been recovered from his conscious possession and he is

Patna High Court Cr.Misc. No.47137 of 2017 (2) dt.22-09-2017 2/2 languishing in judicial custody since 30.07.2017. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ VII cum Special Judge (Excise), Aurangabad, in connection with Mali P.S. Case No. 59/2017.
