1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhagwanpur P.S. Case no.181 of 2023 registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, the informant states that unknown accused persons committed robbery in her house and took away various articles as described in the F.I.R. The same also included the mobile phone of the informant.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. Referring to the order of the learned Court below, it is stated that the name of the petitioner transpired in course of investigation when he was found using one of the stolen mobile phone. Learned counsel

Patna High Court CR. MISC. No.66048 of 2023(2) dt.18-10-2023 2/2 submits that the prosecution is mainly relying on the petitioner being in possession of the stolen mobile phone and the confessional statement of the petitioner made before police in course of investigation. No further stolen article has been recovered on account of the said confession. The petitioner is a student of Class 12 and is at present studying in MRJD College, Begusarai. It was subsequent to this case that he has been implicated in two other cases.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, the material that has transpired in course of investigation as finds mention in the order of the learned trial Court together with his being in custody since 24.7.2023, the petitioner is directed to be enlarged on bail in connection with Bhagwanpur P.S. Case no.181 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
