JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,463,471/34 and 120B of the Indian Penal Code. The prosecution case is that the petitioners twice received the benefits under Indira Awas scheme to the extent of Rs.60,000/- and Rs.50,000/- respectively.
It is submitted by the learned counsel for the petitioners that the petitioners are ready to return the alleged amount. It is further submitted that the petitioners are illiterate and differently able person.
Considering the aforesaid facts, let the above named petitioners be released on provisional anticipatory bail for six months in the event of arrest or surrender before the learned Court
Patna High Court Cr.Misc. No.53215 of 2015 (2) dt.23-11-2015 2/2 below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Industrial Area P.S. Case No.71 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioners shall be confirmed by the learned court below only if the petitioners submit proof of return of the alleged amount. (Dinesh Kumar Singh, J) Anil/- U T
