Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 379,504,506/34 of the Indian Penal Code.

As per the prosecution case, petitioner no.1 snatched gold chain and some cash from the informant, petitioner no.2 assaulted the informant with iron rod causing injury on his hand and petitioner no.3 caused injury on the neck and hand of the informant.

Learned counsel appearing for the petitioners submits that there is land dispute between the parties and informant is the aggressor in this case who were disturbing possession of petitioners on the land in question. It is also submitted that two title suits are also pending between petitioner no.1 and the informant and the instant case has been lodged by the informant only to make pressure upon the

Patna High Court CR. MISC. No.71114 of 2022(2) dt.21-03-2023 2/2 petitioners' side. There is no injury report to support the prosecution case. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Patna city in Bahadurpur Police Station Case No. 119/2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
