The petitioners are apprehending their arrest in a case registered under Sections 272/273/414 of the Indian Penal Code and Section 47(a) of the Bihar Excise Act.
Allegation is that 619 bottles of different brand foreign liquor was recovered from the house of the petitioners. It has been submitted on behalf of the petitioners that the there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is alleged that 671 liters of foreign liquor is said to have been recovered from an abandoned house which does not
Patna High Court Cr.Misc. No.51175 of 2016 (2) dt.29-11-2016 2/2 belong to the petitioners. There is no compliance of Section 100 Cr.P.C.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Raghopur P.S. case No.57 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
