Mr. SRI ARUN KUMAR ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-10-2017 Heard the counsel for the petitioner and the State. Being the Headmaster of the school, the petitioner was entrusted a sum of Rs. 17 lakh and odd under Sarv Siksha Abhiyan for construction of the school building in the year 2016. The informant has alleged that even after receipt of the amount, no construction of the building was made. In spite of reminder, the petitioner did not return the amount. Learned counsel submits that the petitioner, who is languishing in jail custody since 20.07.2017, would deposit a sum of Rs. 16 lakh with the authority which he earlier intended to do so if the privilege of bail is granted. It is stated that such deposit will be without prejudice to his right and contention in the present case.

No.47775 of 2017(2) dt.16-10-2017 2/2 In view of aforesaid, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Shri D. Prakash, Judicial Magistrate, Purnea in Tikapatti P.S. Case No. 51 of 2017. Along with the bail bonds, the petitioner shall enclose a demand draft in the sum of Rs. 16 lakh payable to the appropriate authority and/or receipt/document showing payment of the aforesaid amount to the appropriate authority of the state government. Let it be clarified that such deposit made by the petitioner would be without prejudice to his right and contention in the present case.
